By downloading or using BabyName AI ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

Description of Service

BabyName AI is a mobile application that uses artificial intelligence to generate baby name suggestions based on user preferences. The App is available on iOS devices through the Apple App Store.

Use of the App

You agree to use BabyName AI only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates applicable laws or regulations
• Attempt to reverse engineer, decompile, or extract the source code of the App
• Use automated means to access the App or its features excessively
• Use the App to generate content intended to harm or mislead others

AI-Generated Content

The baby names and descriptions generated by BabyName AI are produced by artificial intelligence. While we strive for accuracy and cultural sensitivity, we cannot guarantee that all AI-generated content is perfectly accurate, culturally appropriate, or suitable for every context.

• Name suggestions are for informational and inspirational purposes only
• We recommend verifying names and their meanings through additional sources before making final decisions
• AI-generated descriptions reflect patterns in training data and may not capture all nuances of cultural naming traditions

In-App Purchases

BabyName AI offers a one-time Pro upgrade purchase through Apple's In-App Purchase system.

• All purchases are processed by Apple and subject to Apple's Terms and Conditions
• The Pro upgrade is a one-time purchase with no recurring fees
• Purchases are non-refundable except as required by applicable law or Apple's refund policy
• You can restore purchases on any device signed in with the same Apple ID

Free Tier Limitations

The free version of BabyName AI includes up to 5 name generations per day. This limit resets daily. We reserve the right to modify free tier limits at any time with or without notice.

Intellectual Property

BabyName AI and all associated content, features, and functionality are owned by us and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

Baby names themselves are not subject to intellectual property protection. You are free to use any names generated by the App for your personal use.

Disclaimer of Warranties

BabyName AI is provided "as is" without any warranties, express or implied. We do not warrant that the App will be error-free, uninterrupted, or free of viruses. The App depends on third-party services (OpenAI API) that may experience downtime or changes.

Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

Third-Party Services

The App uses OpenAI's API to generate content. Your use of the App is also subject to OpenAI's terms of service. We are not responsible for the availability or performance of third-party services.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through good-faith negotiation or, if necessary, through binding arbitration.
